How Pain and Suffering Damages Are Calculated
Pain and suffering is a category of non-economic damages — compensation for physical discomfort, emotional distress, loss of enjoyment of life, and mental anguish caused by an injury. Unlike medical bills or lost wages, these damages have no receipt, making them harder to quantify.
Method 1: The Multiplier Method
Insurance adjusters add up your total economic damages (medical bills + lost wages) and multiply by a factor between 1.5 and 5:
Medical bills: $25,000
Lost wages: $8,000
Multiplier: 3× (herniated disc, 6+ months recovery)
Pain & suffering: ($25,000 + $8,000) × 3 = $99,000
Total claim value: $132,000
Method 2: The Per Diem Method
A daily dollar rate is assigned to each day between the accident and your maximum medical improvement (MMI) date:
Daily rate: $150
Recovery period: 200 days
Pain & suffering: $150 × 200 = $30,000
Multiplier Guide by Injury Severity
- 1.5–2×: Minor sprains, bruises, soft tissue injuries with full recovery in weeks
- 2–3×: Fractures, concussions, moderate whiplash, months of treatment
- 3–4×: Herniated discs, surgery required, chronic pain, 6+ month recovery
- 4–5×: Permanent disability, disfigurement, traumatic brain injury, loss of function
📋 Documentation Matters
Keep a daily pain journal documenting your symptoms, limitations, and emotional state. Consistent medical records and personal documentation significantly strengthen non-economic damage claims.
