Understanding Daily Overtime
Federal law (FLSA) only requires overtime after 40 hours in a workweek. However, several states add a daily overtime threshold, typically 8 hours per day. This protects employees who work long shifts even if their weekly total stays under 40 hours.

Daily vs. Weekly Overtime
If you work in a state with both daily and weekly overtime, your employer generally cannot "double count" overtime hours. For example, California daily OT hours that already counted toward the daily threshold are typically not also applied separately as weekly OT. The employee receives whichever calculation yields a higher total.
