Weekly Overtime: The FLSA Standard
The Fair Labor Standards Act (FLSA) requires employers to pay non-exempt workers 1.5× their regular rate for every hour worked over 40 in a single workweek. This is the default overtime rule across most of the United States.
The Weekly Overtime Formula
Regular Pay = min(Hours, 40) × Hourly Rate
Overtime Pay = max(Hours − 40, 0) × Hourly Rate × 1.5
Total = Regular Pay + Overtime Pay
Example: 48-Hour Week at $22/hr
Regular: 40 × $22 = $880. Overtime: 8 × $33 = $264. Total: $1,144 for the week.
Common Questions About the 40-Hour Rule
Can my employer average two weeks? No. Under FLSA, each workweek stands alone. If you work 50 hours one week and 30 the next, you're still owed 10 hours of overtime for the first week.
Do salaried employees get overtime? It depends. Salaried non-exempt employees still qualify. Salaried exempt employees (earning above the current salary threshold) generally do not.
